Terms of Service

1. Acceptance of Terms
By accessing or using HAVOC ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
These Terms apply to all visitors, users, and others who access or use the Service. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.
2. Accounts
You must authenticate via GitHub OAuth to access HAVOC. You are responsible for maintaining the security of your GitHub account and any access tokens associated with it.
You may not share your account credentials, use automated scripts to create accounts, or use the Service for any purpose not expressly permitted by these Terms.
We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, pose a risk to the security or integrity of the Service.
3. Subscriptions and Billing
HAVOC offers paid subscription plans. Billing is handled by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis according to your selected plan.
Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings or by contacting support.
Refunds are issued at our discretion. If you believe you were charged in error, contact support@havoc.cloud within 30 days.
We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing cycle.
4. Acceptable Use
You may only use HAVOC to scan repositories, URLs, and IP addresses that you own or have explicit written authorization to test. Unauthorized scanning is prohibited and may violate applicable law.

5. Intellectual Property
HAVOC and all associated software, designs, and content are owned by HAVOC Cloud and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service.
Vulnerability scan results and reports generated by the Service belong to you. We retain no ownership of your data, but may use anonymized, aggregated data to improve the Service.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SCAN RESULTS WILL BE COMPLETE OR ACCURATE.
Security scanning is inherently limited. HAVOC does not guarantee detection of all vulnerabilities. Do not rely solely on HAVOC for security assurance.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAVOC CLOUD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM.
8. Termination
You may close your account at any time. We may suspend or terminate your access for violation of these Terms, non-payment, or any reason we deem necessary to protect the Service or other users.
Upon termination, your scan data will be retained for 30 days before deletion unless applicable law requires longer retention.
9. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Texas.
